Evening Court: Union Law Ministry is Planning to Start Evening Courts Across the Country

To ease the heavy caseload in district courts across the country, the Union Law Ministry is planning to start 785 evening courts across the country. As per the plan, these courts will function in the evenings in existing court complexes. It will cover summary trial cases including petty offences, small property disputes and cheque dispute cases, which carry a maximum sentence of three years. The Law Ministry has prepared a concept note in this regard, which was sent to all states last month.
Retired Judges & Employee will be Appointed on a Contractual Basis for 3 Years
Under the proposed scheme, retired district judges and retired court employees will be appointed on a contractual basis for a period of three years and will get 50% of their last salary and applicable dearness allowance. If other retired employees are hired, the same rules will apply to them as well.
Evening Courts will Function from 5pm to 9 pm
The note also states that such evening courts will function on all working days between 5 pm and 9 pm. Before this time, the regular courts will function smoothly. Later, the facilities of the same court will be used for the evening courts.
Hearing of Minor Criminal Cases Pending for More than 3 Years
The proposal also states that the proposed courts can hear minor criminal cases pending for more than three years, which can carry a sentence of up to three years in prison. This will then be extended to include cases carrying a sentence of up to six years in prison.
How Many Cases are Pending in the Country?
It is worth mentioning that there are a lot of cases pending in the courts of the country. According to the data available on the National Judicial Data Grid Portal, a total of 4.60 crore cases were pending as on february 21 this year. Out of which 1.09 crore were civil cases and 3.5 crore were criminal cases. Of these, 44.55% of the cases have been pending for more than three years. One of the major reasons for these pending cases is the shortage of judicial officers.
